This can be unlocked as early as after completing Chapter 1, ‘An Offer You Can't Refuse’ once ‘Free Ride’ mode is unlocked.
From the main menu, select ‘Free Ride’. When you spawn at the back of Salieri’s Bar, run to the street and either steal a vehicle or fire your weapon (if you have one). If there is a witness, you will receive a 2-star wanted level (shown above your mini-map). Remain in the area (there will be an ‘eye’ icon on your mini-map), and when the stars turns blue, a nearby police vehicle will respond to the crime. When they do, just stand there and let the officer approach you (if you stole a vehicle, exit it).
