You can get this at the very first level. Make sure to crouch and press RT in order for it to count. You have to be behind the enemy for it to trigger.
If you loot the enemy before you kill him, it will count towards the Thief achievement.
I've yet to confirm it, but I don't think you can kill an enemy and then reset checkpoint.

I tried killing the first 3 guys and then loading the save before and repeating until 10 kills and that did not work

Sneak (press c) up behind any guards undetected and press left mouse button. Do this 10 times in one playthrough or instance of mission select. Cheevo popped.
