The M4 will be given at the beginning of the mission "Rub Out". It is not possible to buy this weapon at Ammo Nation in Downtown already.
Before you reach Diaz, you have to kill a lot of other people. Kill them with another weapon so you will have enough ammo to kill Diaz after he retreats in his office.

So save m4 till get him , buggy gs this , radio achievement broken hell, all games need patched , the cut schemes so dark with brightness n contrast on full, I GT it sake 35 so can't moan much day one buyers at £50, cheaper me but this than PS2 n three games

The mission "Rub Out" will be about 15 missions in, depending on how many side-missions you have done, for me it was immediately after the mission "Death Row".
This mission is not too hard. Follow Lance inside the mansion, through the back door, killing the Diaz gang members along the way. Inside, I found taking 2 flights of stairs made this mission easier (3 flights takes you to the roof). As you approach the office, Diaz will appear, and after taking a few shots, will retreat into his office, at this point, switch to the M4. This achievement will unlock during the cutscene.

Not too long after unlocking the second island you'll come across a mission that involves saving Lance after he was captured. Once you complete this mission, you may want to make a save file as a backup in case something goes wrong.
When you start this mission you'll be given the M4 from the start, if you want to play it safe make your way through the mansion using a different weapon so you don't run out of ammo. Once you reach Diaz, simply use the M4 to take him out. If you're having trouble controller the recoil, you can actually fire this weapon without using L2 to aim. Holding R2 alone will have Tommy fire it without recoil or first person.
