Either play with three controllers or play with computer opponents. When another player other than you lands on the lawsuit space (could be a second controller or the computer may pick you), simply pick yourself as one of the defendants and wiggle your control stick until you win.

While, like transam182 says, this achievement can be won with two computer opponents, be aware that this brings a possible negative side effect; if one of the computer opponents lands on the lawsuit space both you AND the other computer opponent will be involved in the suit. IF the other computer opponent plays an EXEMPTION CARD then YOU will be AUTOMATICALLY STUCK for the ENTIRE $100,000 damage award with NO CHANCE of defending yourself by playing the mini-game. (This happened to me 3-4 times within ONE GAME...)

If I play against one computer opponent and HE sues ME this achievement doesn't unlock. If I sue HIM it doesn't unlock. In both cases I waggle it until the bar is full with time to spare.

What am I missing? Should I just use another controller (or two)?

Hey just to help out with my solution, you need to be playing with three players total at least (yourself and two others whether or not they are computer players or another two controllers). This is so that you have someone to actually compete against during a lawsuit. If you are just playing with two players, you get to defend, but only to reduce the amount you get sued (I believe). If your playing with three players, then your wiggling the stick translates into you trying to stick the other player with having to pay the lawsuit, which is what will net you the achievement.
