This achievement is part of update 1.6 which brought hardcore difficulty into the game as a free new feature.
Just die to get it. The fastest way is to combine it with firestarter achievement. Right in the beggining of the first Quest go to the vilage and steal something off a merchant's table, get caught, go to jail and there you go. Also this will come during the natural course of play on hardcore as they say.

No trick about this, just die during your playthrough on the Hardcore Mode difficulty to unlock it. This will happen at some point with or without trying. Your save file won't be deleted if you do so don't worry about that.
