I didn't encounter this guy at all in 3 runs through the Judge. I found him on the Angel of Death story on my first run. You just need to choose the 'tell the truth' option, I think it was 3 times towards the end of the conversation when he asks if you believe in god.

Had to miss him he's an evil looking guy with a beard. He's usually one of the suspects.
