You get The Lost Battalion achivement regardless, I DID NOT SHOOT him and let him go on my first playthrough and I got the The Lost Battalion.

My TA says I have not won it, but the scanner already scanned for today so it should show up in a bit :) There is Raptr update showing I have it and I repeat I DID NOT SHOOT the guy, so at this decision point it doesn't matter, unless later on something happens. Besides the conversation that happens after your decision.
