This is story related and cannot be missed. In order to face Aaron Keener, you must be Level 40.
Along with completing side/main missions and killing enemies, there are many other ways to gain XP; completing activities (taking Control Points, completing Bounties, shutting down Propaganda Broadcasts, and other question marks dotted throughout Lower Manhattan), discovering safe houses, collecting Comms, activating ECHOs and completing projects. If you are doing these while playing through Warlords of New York, you should unlock this well before facing Aaron Keener.
