In your conversation with Victory at the end of Little Hell in Aspen, continue to tell him to surrender, then use the Arrest option, refusing his offer to join you.

To arrest Victory, you need to get to him first by clearing out Aspen. Get to him, and tell him he's under arrest. Despite being crazy, he'll go without a fight.
