Incredibly easy -- during the prologue, when the "Ask" prompt appears, scroll right to the Verdict book, and select Guilty or Not Guilty without taking any other actions. The achievement will pop.

This can also be done on the very first case of the game without any repercussions, if you wanted (you can reload days, but the non-story related cases will randomize, and I found reloading the autosave to be a bit buggy on the Xbox version).
